1. 1. Draft Notification of the Ministry of Public Health on Names of Objects Prohibited for Use as Ingredients in the Production of Cosmetics (No. ..) B.E. ....

1) The 38th ACSB concluded that DEET can be used in insect repellent products such as mosquitoes and ticks, and products that use DEET as an important substance in liquids, lotions, sprays and impregnated materials such as cold towels, cold paper, and roll-ons that are applied directly to human skin for insect repellent purposes are not classified as cosmetics in ASEAN but are classified as pesticides. The meeting resolved to add DEET to the ASEAN Cosmetic Directive (ACD) Annex II with immediate effect.

2) From searching for information on the registration of DEET in Thailand. It was found that no cosmetics containing such substances were registered and were not banned (as of January 10, 2024).

Three. The draft announcement adds N, N-diethyl-meta-toluamide or diethyltoluamide (DEET) as prohibited substances in accordance with ACD.

2.Draft Notification of the Ministry of Public Health on Determination of Colors that May Be Used as Ingredients in the Production of Cosmetics (No. ..) B.E. ....

1) The 38th ACSB Meeting considered the purity criteria of CI 77266, CI 26100, and CI 45430 in ACD Annex IV, in which the Meeting resolved to eliminate the purity criteria of CI 45430 in order to match the EU regulation and maintain the purity criteria of other colors.

2) Currently, CI 45430 or Disodium 2-(2,4,5,7-tetraiodo-6-oxido-3-oxoxanthen-9yl)benzoate and its insoluble barium, strontium and zirconium lakes, salts and pigments are the 80th substance according to the Ministry of Public Health's Notification on Determining Colors That May Be Used as Ingredients in Cosmetic Production B.E. 2564 (2021) dated May 20, 2021.

2.1) Contains 2-(6-hydroxy-3-oxo-3Hxanthen-9-yl) benzoic acid contamination not more than 1%

2.2) Contains 2-(iodo-6-hydroxy-3-oxo3H-xanthen-9-yl) benzoicacid contamination not more than 3%.

2.3) From searching for registration data using CI 45430 color in Thailand. A total of 1,295 CI 45430 cosmetics were found to be unaffected.

Three. The draft declaration is an update by removing the purity criteria of CI 45430 list colors to comply with ACD.

3. Draft Notification of the Ministry of Public Health on the Determination of Sun Protection Agents that May Be Used as Ingredients in the Production of Cosmetics (No. ..) B.E. ....

1) From the EU 2022/2195, the list of substances HAA299 or Bis-(Diethylaminohydroxybenzoyl benzoyl) Piperazine (CAS No 919803-06-8) and HAA299 (nano) or Bis-(Diethylaminohydroxybenzoyl Benzoyl) Piperazine (nano) (CAS No 919803-06-8) has been added as a new substance.

2) The efficacy and safety of both nano and non-nano forms have been assessed as safe to use as a sun protection agent at a maximum concentration of 10%, with additional use conditions for nano forms.

3)  At the 38th ACSB meeting, the meeting resolved to add the list of such substances as sun protection agents in ACD Annex VII with immediate effect.

4. Draft Cosmetic Commission Notification Re: Display of Warnings on Cosmetic Labels Containing Sun Protection (No. ..) B.E. ....

⁠⁠⁠⁠⁠⁠⁠Revision of the list of sun protection substances that may be used by raising the draft notification of the STI on the designation of sun protection substances that may be used as ingredients in the production of cosmetics (No. ..) B.E. (added list of HAA-299 nano form and non nano form) The list of sun protection agents requires a warning display on the label to protect consumers.
